1.- ACCEPTANCE OF CONDITIONS

The Meteorological Service of Catalonia (henceforward "SMC") informs you that access to and use of the website www.meteo.cat as well as other related domains, together with all the services and/or products offered on its website, are subject to these conditions of use. As a result, any use of the website and/or its services and/or products made by the User entails his/her acceptance of the terms detailed in these conditions.

2.- MODIFICATION OF CONDITIONS

The SMC reserves the right to maintain or modify the meteorological information on its website for the purpose of improving the services and/or products offered to Users. By changing the legal notice or the conditions of use on its website, the SMC will understand its duty to inform as having been met. In any event, the legal notice and the conditions of use will always be available for Users to consult.

3.- RESPONSIBILITY

The SMC offers users of the website all the technical and personnel resources available to it in order to ensure they receive the latest information in real time, but under no circumstances can it be held responsible for any modifications and/or changes to the information provided as a result of applying quality control processes at a later date, nor if it becomes impossible to recover information consulted earlier.

The SMC accepts no responsibility whatsoever deriving from the incorrect, inappropriate or illicit use of the information appearing on its website. The sole responsibility for using the website falls upon the User. This responsibility also extends to the use the User may make of passwords or identifying codes which the SMC may provide to access certain contents of its website.

Within the sole limits established by law, the SMC is exonerated from any responsibility deriving from the lack of accuracy, veracity, topicality or precision of the data and information on its website.

With regard to the SMC’s meteorological information, this is provided with the utmost possible level of accuracy permitted by its own resources and its technical and scientific knowledge of the field. For this reason, the SMC will not be responsible for any possible damage caused by the interpretation and use of the meteorological information presented on the website.

With regard to the information from the Network of Meteorology Equipment of the Catalunya, the SMC advises Users that this information is made available before the SMC has carried out is quality controls, so the SMC cannot be responsible for this kind of information until it has been properly checked, at which time it will appear be identified on the SMC website as corroborated information.

The SMC is not responsible for the contents of any links to other websites which are not its property or for the operation of those links or any possible damages that may be caused from using or accessing them.

4.- INTELLECTUAL PROPERTY

The SMC website and all its contents, including texts, images, databases, codes or any other material, are the property of the Generalitat of Catalonia, the Department of the Environment and Housing, the Meteorological Service of Catalonia, and/or, where applicable, third parties which may have authorised the use of this content by the relevant organisation. Any form of transmission, distribution, transfer, reproduction, storage or total or partial public communication must be expressly authorised by its owner.

All the contents provided on the SMC website are subject to intellectual property rights legislation. In this respect, the owners of these rights reserve the right to take whatever legal action may be necessary to repair the damages caused by any illegal act.

The fact of acquiring a product and/or service does not entitle the User any kind of intellectual property rights over the material, all rights being reserved at all times by their owner.

5.- DATA PROTECTION 

In accordance with Organic Law 15/1999, of 13 December 1999, on the Protection of Personal Data, the SMC informs you that the personal data gathered on its website by the completion of forms, by sending SMS to mobile phones, by telephone calls to the "Telèfon del Temps" and/or by sending emails, will be processed and added to the SMC’s databases solely and exclusively to provide a response to services requested by the User relating to meteorological information. In this respect, the User gives his/her express consent for this personal data to be processed for the purposes indicated above.

Unless specifically stated to the contrary, it is considered necessary to complete and provide the details requested on the website in order to efficiently provide the products and/or service requested. If all the details regarded as necessary are not provided, the SMC will not be able to register the User or will have to refuse the specific service requested.

The data provided by Users should be true, accurate, complete and up-to-date and the User will in all cases be held responsible for any damages which may be caused by providing false, inexact, incomplete or non-updated details.

The personal details of Users will not be transferred to any third parties and will only be used by the SMC for the purposes established for their collection.

Users may exercise their right to access, rectify, cancel or oppose the use of these data by writing to the SMC at C. Berlín 38-46, 4t, 08029 Barcelona or by sending an email to smc@meteo.cat.

In all cases, the SMC will treat all the personal data gathered with complete confidentiality in its databases, which are duly registered with the Data Protection Register of Catalonia at the Catalan Data Protection Agency.

6.- E-COMMERCE COMMUNICATIONS

In accordance with Law 34/2002, of 11 July 2002 on Information Society Services and Electronic Commerce, the User is informed that by accepting these conditions he/she expressly consents to receiving commercial communications by electronic means on SMC’s products and/or services relating to meteorological information. Likewise, Users are informed that they may revoke their consent to receiving electronic communications at any time by sending an email to smc@meteo.cat.

7.- APPLICABLE LEGISLATION

The resolution of any disputes which may arise in relation to these conditions of use for the SMC website will be governed by the laws of Spain and the Autonomous Community of Catalonia.
